Limitations and Exclusions

 

First Protector General Limitations and Exclusions:

 

The insurance described is subject to all terms and conditions of the insurance policy/certificate, which you should review for details upon receipt, and which are subject to change.

 

Commercial Properties are not eligible for coverage.  Commercial properties are defined as: the use of residential property primarily for income generation by operating a business, selling products or providing services from such residential property; or the use of residential property solely for rental purposes, and not rented or held for rental to the same tenant for a lease term of 6 consecutive months or more.

 

First Protector State Availability:

 

State specific eligibility restrictions vary, and are provided when you submit a request to get an        

"Instant Quote."

 

This product is not available in: CT

 

In UT, coverage is approved under policy number AR9066PKK-0399.

 

This product is underwritten by American Bankers Insurance Company of Florida (ABIC), an Assurant Specialty Property company.

 

 

First Protector Benefit Specific Conditions:

 

Mortgage Payment Protection for Disasters Benefit:


Conditions:

 

• The insured home must be temporarily uninhabitable for more than 48 hours due to a

   covered disaster.

 

• In all states except TX, this benefit is limited to 3 monthly payments if repairs are not started

   within 90 days from the date of loss.

 

• In TX, this benefit is limited to 4 monthly payments if repairs are not started within 120 days

   from the date of loss. A 30-day extension and 5 monthly payments are provided when repair,

   reconstruction, or restoration is delayed for reasons beyond your control.

 

• An extension to 180 days to start repairs is available at an additional cost, in all states

   except NY.

 

• Benefits are retroactive to the first day of displacement after a 30-day waiting period.

 

• A maximum of 24 monthly payments are provided.

 

• The monthly mortgage payment benefit is payable up to the limit of liability shown on

   your policy/certificate.

 

 

Mortgage Balance Payoff for Disasters Benefit:

 

Benefit availability: Mobile Homes are not eligible for this benefit.

 

Conditions:

 

• Pays the total unpaid balance of the mortgage up to the limit shown on the declarations of

   your policy/certificate, less:

     1. unearned finance charges

     2. unearned interest charges

     3. unearned insurance premiums

     4. charges and penalties that you owe to your financial institution

 

• To qualify for a benefit payment, the land the home is located on must be condemned or

   judged permanently unfit for rebuilding or reconstruction, as determined by a governmental

   agency.

 

• Benefits are payable after proceeds are paid on any other collectible insurance.

 

 

Reimbursement of Homeowners Policy Deductible Benefit:


Conditions:

 

• In all states except TX, the coverage limit is available at $500 or $1,000.

 

• In TX, the coverage limit is only available at $1,000.


• Deductible reimbursement only applies for dwelling claims paid on your primary

   homeowner's policy.

 

• A maximum of 2 losses in any consecutive 12 month period is permitted.

 

 

Mortgage Payment Protection for Involuntary Job Loss Benefit:

 

Benefit availability: This benefit is not available in MA, NH, NY, PA, TX and WI.

 

Conditions:

 

To be eligible for this benefit you must:

 

• Have an unconditional obligation to pay the monthly mortgage amount.

 

• Be working at least thirty (30) hours a week for at least nine (9) consecutive months of

   the year.

 

• Not be a seasonal employee, an independent contractor, or self-employed.

 

Eligibility for joint coverage of this benefit requires:

 

• The joint applicant must also be named on the mortgage.

 

Eligibility for proceeds under this benefit requires that you:

 

• Are involuntarily unemployed as a result of Individual or Mass Layoff, General Strike

  (n/a in IL), Termination by Employer without Cause, Unionized Labor Dispute (n/a in IL),

  or Lockout (n/a in IL).

 

• Satisfy the thirty (30) day waiting period.

 

• Provide us with proof of your unemployment, adequate proof of your outstanding monthly

   mortgage, proof that you qualify for unemployment benefits under a state

   unemployment law.

 

• Provide proof that you are registered for work with a state unemployment office or

   recognized employment agency within fifteen (15) days after the last day worked and remain

   registered during the claim period.

 

• Become unemployed during the policy/certificate period.

 

You will not be eligible for proceeds under this benefit if your involuntary job loss:

 

• Results from:

- Seasonal, contracted, part-time (less than 30 hours per week), or self-employment;

- Military service;

- Disability;

- Willful or criminal misconduct;

- Prior or written notification of pending unemployment was received by you before the

  effective date of coverage;

- (In IL) General strike, unionized labor dispute, and lockout.

 

• Occurs during the first 30 days from the effective date of coverage.

 

If you become eligible for proceeds under the involuntary job loss benefit we will pay you the monthly benefit amount for the number of months reflected on your policy/certificate, up to the aggregate limit of liability or until you are no longer involuntarily unemployed, whichever occurs first.

 

Emergency Cash for Disasters Benefit:

 

Benefit availability: This benefit is not available in NY.

 

Conditions:

 

• A primary homeowner's insurance policy/certificate on the home must be in effect at time of

   covered loss.

 

• Payment will not be made until the home is uninhabitable and vacant for 48 hours due to

   damage from a covered disaster.

 

• Benefit coverage does not apply if the home was vacant for more than 60 days prior to

   the loss.

 

• Benefit payment is limited to one payment for one loss within any 12 consecutive

   months of the policy/certificate period.

 

• Benefit coverage does not apply to non-owner occupied properties or rentals.

 

• Loss is covered under primary homeowners policy.

 

• In KS, you must reside in the home more than 50% of the year.

 

 

General First Protector Exclusions:

 

These general exclusions apply to all of the benefits described above.

 

          • Losses that result from war

 

          • Events that cause allergies (not excluded in TX)

 

          • Noise

 

          • Pollution

 

          • Contamination

 

          • Certain types of virus or bacteria (n/a in CA, FL, GA, HI, KS, MA, ME, NJ, NM, VA and VT).

             Mold is not excluded in AK and IL.

 

          • Normal wear and tear

 

          • Riot

 

          • Neglect

 

          • Vandalism of property vacant more than 60 days

 

          • Interruption of power

 

          • Intentional or dishonest acts

 

          • Conditions known by you to exist before purchase of this insurance

 

          • Governmental activity, including seizure, confiscation or destruction by a governmental or 

             public authority

 

          • Faulty or inadequate planning, surveying, design, workmanship, construction, materials or

             maintenance

 

          • Losses caused by perils not insured under this policy/certificate

 

 

Service Benefits for Disaster Recovery

These benefits do not pay for any repair work or materials provided by contractor(s) and or experienced tradespersons.
